Article R1322-14 of the French Public Health Code

The Prefect may, on his own initiative, on a proposal from the Director General of the Regional Health Agency, or at the request of the operator and in accordance with the procedure laid down inarticle R. 1322-6, issue an order amending the authorisation order, if he considers that the maintenance of certain provisions is no longer justified or that additional requirements are necessary in order to ensure the safety of the water distributed.

Before issuing the order, the Prefect may issue a reasoned decision requiring the operator to supply or update the information contained in the application file and to produce additional operating reports. The operator is responsible for these measures.

Article R1322-14

Le préfet peut prendre, à son initiative, sur proposition du directeur général de l’agence régionale de santé, ou à la demande de l’exploitant et conformément à la procédure prévue à l’article R. 1322-6, un arrêté modificatif de l’arrêté d’autorisation, s’il estime que le maintien de certaines dispositions n’est plus justifié ou que des prescriptions complémentaires s’imposent afin d’assurer la sécurité sanitaire de l’eau distribuée.

Avant de prendre son arrêté, le préfet peut prescrire à l’exploitant, par une décision motivée, la fourniture ou la mise à jour des éléments contenus dans le dossier de la demande d’autorisation et la production de bilans de fonctionnement supplémentaires. Ces mesures sont à la charge de l’exploitant.
