Article R1322-27 of the French Public Health Code

The provisions of article R. 1322-26 are applied in cases where the owner of a natural mineral water spring declared to be in the public interest asks the Prefect to provisionally order, in application of article L. 1322-6, the suspension of drilling or underground work undertaken outside the protection perimeter and which he indicates is likely to alter or reduce the flow of the spring.

If the Prefect remains silent for more than two months, the request is rejected.

Il est procédé conformément aux dispositions de l’article R. 1322-26 dans le cas où le propriétaire d’une source d’eau minérale naturelle déclarée d’intérêt public demande au préfet d’ordonner provisoirement, en application de l’article L. 1322-6, la suspension d’un sondage ou d’un travail souterrain entrepris en dehors du périmètre de protection et qu’il signale comme étant de nature à altérer ou à diminuer le débit de la source.

Le silence gardé par le préfet pendant plus de deux mois vaut rejet de la demande.
