Article R1322-44-8 of the French Public Health Code

Without prejudice to the provisions of articles R. 1322-44-6 and R. 1322-44-7 and whether or not the quality criteria have been complied with, the Prefect, when he considers, on the basis of a report from the Director General of the Regional Health Agency, that the operation or use of the water constitutes a danger to human health, asks the operator to take any measures necessary to protect human health or to suspend operation.

The operator informs the Prefect of the effective application of the measures taken.

Sans préjudice des dispositions des articles R. 1322-44-6 et R. 1322-44-7 et que les critères de qualité aient été ou non respectés, le préfet, lorsqu’il estime, sur le rapport du directeur général de l’agence régionale de santé, que l’exploitation ou l’usage de l’eau constitue un danger pour la santé des personnes, demande à l’exploitant de prendre toute mesure nécessaire pour protéger la santé des personnes ou d’interrompre l’exploitation.

L’exploitant informe le préfet de l’application effective des mesures prises.
