Article R1322-7 of the French Public Health Code

When it is planned to use the water for therapeutic purposes in a spa establishment or when the applicant wishes to demonstrate the health benefits of water intended for packaging or distribution in public refreshment areas, and subject to the favourable opinion of the Departmental Council for the Environment and Health and Technological Risks on the application for authorisation to exploit the mineral water source, the dossier mentioned in article R. 1322-5 is supplemented by clinical and therapeutic studies.

The Prefect forwards a copy of the application to the Minister for Health, who refers the matter to the National Academy of Medicine for its opinion.

The Académie nationale de médecine gives its opinion within four months of receiving the application. The Minister for Health immediately sends his opinion to the Prefect and the Director General of the Health Agency. In the absence of an opinion within four months, the opinion is deemed to be unfavourable.

In the case of a revision of the authorisation to operate, the opinion of the Académie nationale de médecine is not required if the characteristics of the mineral water are unchanged compared to the authorisation to operate in force.

Article R1322-7

Lorsqu’il est projeté d’utiliser l’eau à des fins thérapeutiques dans un établissement thermal ou lorsque le demandeur souhaite faire état d’effets favorables à la santé d’une eau destinée au conditionnement ou à la distribution en buvette publique, et sous réserve de l’avis favorable du conseil départemental de l’environnement et des risques sanitaires et technologiques sur la demande d’autorisation d’exploiter la source d’eau minérale, le dossier mentionné à l’article R. 1322-5 est complété par des études cliniques et thérapeutiques.

Le préfet transmet un exemplaire de la demande au ministre chargé de la santé qui saisit pour avis l’Académie nationale de médecine.

L’Académie nationale de médecine se prononce dans le délai de quatre mois à compter de la réception du dossier. Le ministre chargé de la santé transmet immédiatement son avis au préfet et au directeur général de l’agence de santé. En l’absence d’avis exprimé au terme du délai de quatre mois, l’avis est réputé défavorable.

Dans le cas d’une révision de l’autorisation d’exploiter, l’avis de l’Académie nationale de médecine n’est pas requis si les caractéristiques de l’eau minérale sont inchangées par rapport à l’autorisation d’exploiter en vigueur.
