Article R133-39 of the French Tourism Code

As soon as the application is complete, the Prefect examines it.

If the application complies, the Prefect will issue a decree classifying the municipality for the period specified in article L. 133-15, within three months. The order defines the boundaries of the classified area. Where this does not coincide with the municipal territory, a map is appended to the order.

Rejection of the application for classification is the subject of a reasoned decision, silence being deemed to constitute rejection of the application on expiry of the period referred to in the previous paragraph.

Article R133-39

Dès la complétude du dossier, le préfet instruit la demande.

En cas de conformité et dans un délai de trois mois, il prononce par arrêté le classement de la commune pour la durée fixée à l’article L. 133-15. L’arrêté délimite le territoire classé. Lorsque celui-ci ne se confond pas avec le territoire communal, un plan est annexé à l’arrêté.

Le rejet de la demande de classement fait l’objet d’une décision motivée, le silence valant rejet de cette demande à l’expiration du délai mentionné à l’alinéa précédent.
