Article R1331-16 of the French Public Health Code

Failure to comply with the health and hygiene rules laid down in this section constitutes offences which are investigated and recorded in accordance with article L. 1312-1 and punished in accordance with article R. 1312-14.

It may also, depending on the nature of the rules disregarded, their importance or their accumulation, and having regard to the possible risk or danger resulting therefrom, constitute :

1° an emergency situation justifying the immediate implementation of health measures, in accordance with article L. 1311-4;

2° or an insalubrious situation among those defined in articles L. 1331-22 and L. 1331-23, falling under the State representative’s authority to police the health of buildings, premises and installations as provided for in 2° of the Article L. 511-4 of the French Construction and Housing Code and Articles 9 and 10 of Act 2011-725 of 23 June 2011 containing special provisions relating to informal housing districts and the fight against substandard housing in overseas departments and regions;

3° or one or more disorders that do not constitute a danger or risk to people’s health, but which need to be remedied for health or hygiene reasons, falling under the administrative police powers of the mayor pursuant toarticle L. 1421-4 of this Code andarticle L. 2212-2 of the General Code for Local Authorities.

Article R1331-16

La méconnaissance des règles sanitaires d’hygiène et de salubrité édictées par la présente section est constitutive d’infractions recherchées et constatées conformément à l’article L. 1312-1 et sanctionnées conformément à l’article R. 1312-14.

Elle peut également, selon la nature des règles méconnues, leur importance ou leur cumul, et eu égard à l’éventuel risque ou au danger qui en résulte, constituer :

1° une situation d’urgence justifiant que soient ordonnées, conformément à l’article L. 1311-4, l’exécution immédiate de mesures sanitaires ;

2° ou une situation d’insalubrité parmi celles définies aux articles L. 1331-22 et L. 1331-23, relevant du pouvoir de police de la salubrité des immeubles, locaux et installations du représentant de l’Etat prévu au 2° de l’article L. 511-4 du code de la construction et de l’habitation et aux articles 9 et 10 de la loi n° 2011-725 du 23 juin 2011 portant dispositions particulières relatives aux quartiers d’habitat informel et à la lutte contre l’habitat indigne dans les départements et régions d’outre-mer ;

3° ou un ou plusieurs désordres non constitutifs d’un danger ou risque pour la santé des personnes mais nécessitant qu’il y soit mis fin pour des motifs d’hygiène ou de salubrité, relevant de la police administrative du maire en application de l’article L. 1421-4 du présent code et de l’article L. 2212-2 du code général des collectivités territoriales.
