Article R1331-73 of the French Public Health Code

In the case of individual fireplaces and appliances, maintenance and sweeping are carried out at the occupant’s initiative, unless otherwise stipulated in the lease.

In the case of collective fireplaces and appliances, maintenance and chimney sweeping are carried out at the initiative of the owner, the co-owners’ association or, if an agreement so provides, the building operator. Occupants must be given sufficient notice of the visit of the professionals responsible for maintenance and sweeping, and must make all necessary arrangements to allow these operations to take place.

Dans le cas des foyers et appareils individuels, l’entretien et le ramonage sont effectués à l’initiative de l’occupant, sauf stipulation contraire du bail.

Dans le cas des foyers et appareils collectifs, l’entretien et le ramonage sont effectués à l’initiative du propriétaire, du syndicat des copropriétaires ou, si une convention le prévoit, de l’exploitant de l’immeuble. Les occupants sont prévenus suffisamment à l’avance du passage des professionnels chargés de l’entretien et du ramonage, et prennent toutes dispositions utiles pour permettre ces opérations.
