Article R1333-98 of the French Public Health Code

I.-The representative of the State in the département shall draw up a plan defining the public utility easements, from among those provided for in article L. 1333-26, designed to limit the risks associated with environmental pollution due to the presence of radioactive substances or the exposure of persons to ionising radiation that may result therefrom.

II – The perimeter of the public utility easements is delimited taking into account the characteristics of the plots, in particular the topography, hydrography, hydrogeology, plant cover, existing buildings and roads.

I.-Le représentant de l’Etat dans le département arrête le projet définissant les servitudes d’utilité publique, parmi celles prévues à l’article L. 1333-26, de nature à limiter les risques liés à la pollution de l’environnement par la présence de substances radioactives ou à l’exposition de personnes à des rayonnements ionisants pouvant en provenir.

II.-Le périmètre des servitudes d’utilité publique est délimité en considération des caractéristiques des parcelles, notamment de la topographie, de l’hydrographie, de l’hydrogéologie, du couvert végétal, des constructions et des voies existantes.
