Article R137-1 of the French Intellectual Property Code

The assessment of the significant quantity of protected works and objects mentioned in the first paragraph of article L. 137-1 is assessed on a case-by-case basis under the conditions and according to the criteria mentioned in the last paragraph of this article.

The significant quantity of protected works and objects mentioned in article L. 137-1 may be deemed to have been reached when the service’s audience exceeds a threshold set by order of the minister responsible for culture and the number of protected works and objects exceeds a threshold set by order of the minister responsible for culture.
The significant quantity of protected works or objects referred to in Article L. 137-1 may in particular be deemed to have been reached when the service’s audience exceeds a threshold set by order of the Minister responsible for culture and the number of content files uploaded by users of this service exceeds one of the thresholds set by this order.

Article R137-1

L’évaluation de la quantité importante d’œuvres et objets protégés mentionnée au premier alinéa de l’article L. 137-1 fait l’objet d’une appréciation au cas par cas dans les conditions et selon les critères mentionnés au dernier aliéna de cet article.

La quantité importante d’œuvres ou d’objets protégés mentionnée à l’article L. 137-1 peut notamment être réputée atteinte lorsque l’audience du service dépasse un seuil fixé par arrêté du ministre chargé de la culture et que le nombre de fichiers de contenus téléversés par les utilisateurs de ce service dépasse un des seuils fixés par cet arrêté.
