Article R1411-58-12 of the French Public Health Code

Staff representatives are not taken into account for the application of the first paragraph of I of Article L. 1411-5-2:

1° When it is established, on the date of drawing up the electoral lists for the election of staff representatives to the Board of Directors, that the proportion of either sex among the persons eligible for this election is less than 40%;

2° When, after the results of the ballot, the difference between the number of elected women full members and the number of elected men full members is greater than one, despite compliance with the rules laid down in article R. 1411-58-10.

Les représentants du personnel ne sont pas pris en compte pour l’application du premier alinéa du I de l’article L. 1411-5-2 :

1° Lorsqu’il est constaté, à la date d’établissement des listes électorales en vue de l’élection des représentants du personnel au conseil d’administration, que la proportion de l’un ou l’autre sexe parmi les personnes éligibles à cette élection est inférieure à 40 % ;

2° Lorsqu’après les résultats du scrutin, l’écart entre le nombre d’élus titulaires femmes et le nombre d’élus titulaires hommes est supérieur à un, malgré le respect des règles prévues à l’article R. 1411-58-10.
