Article R1415-1-13 of the French Public Health Code

The services provided for in article L. 1415-8 are carried out, in facilities which have signed the agreement provided for in article R. 1415-1-12 or under the responsibility of such a facility, by professionals qualified to provide adapted physical activity as defined in article L. 1172-1, dieticians mentioned in article L. 4371-1 and psychologists. The training qualifications required of these professionals are set by order of the ministers responsible for health and social security.

Where the professionals referred to in the previous paragraph are not employed by the structure, the latter shall enter into a contract with them, in accordance with a standard contract defined by order of the ministers responsible for health and social security, setting out the terms and conditions of their remuneration for a sequence of services as well as the information transmitted, with the patient’s consent in the case of information covered by medical confidentiality, by these professionals to the patient’s prescribing doctor and attending doctor as well as to the structure, for the purposes of the territorial evaluation of the system.

Les prestations prévues à l’article L. 1415-8 sont réalisées, dans les structures ayant conclu la convention prévue à l’article R. 1415-1-12 ou sous la responsabilité d’une telle structure, par des professionnels habilités à dispenser une activité physique adaptée définie à l’article L. 1172-1, des diététiciens mentionnés à l’article L. 4371-1 et des psychologues. Les titres de formation dont doivent disposer ces professionnels sont fixés par arrêté des ministres chargés de la santé et de la sécurité sociale.

Lorsque les professionnels visés par l’alinéa précédent ne sont pas salariés de la structure, cette dernière conclut avec eux un contrat, conforme à un contrat type défini par arrêté des ministres chargés de la santé et de la sécurité sociale, prévoyant leurs modalités de rémunération pour une séquence de prestations ainsi que les informations transmises, avec l’accord du patient pour les informations couvertes par le secret médical, par ces professionnels au médecin prescripteur et au médecin traitant du patient ainsi qu’à la structure, pour l’évaluation territoriale du dispositif.
