Article R1418-31 of the French Public Health Code

In order to carry out its missions, the Agence de la biomédecine may in particular:

1° Acquire the necessary movable or immovable property;

2° Allocate grants, loans or advances from its own budget to public or private bodies carrying out studies, research, work or equipment contributing to the fulfilment of its missions;

3° Pay, before the service is rendered, to the benefit of foreign health establishments and by way of derogation fromarticle 33 of decree no. 2012-1246 of 7 November 2012 relating to public budgetary and accounting management, the expenses relating to the provision of transplants provided for in article L. 1418-1 (8°).

Pour l’exercice de ses missions, l’Agence de la biomédecine peut notamment :

1° Acquérir les biens meubles ou immeubles nécessaires ;

2° Attribuer sur son budget propre des subventions, prêts ou avances à des personnes publiques ou privées qui réalisent des études, recherches, travaux ou équipements concourant à l’accomplissement de ses missions ;

3° Payer, avant service fait, au profit des établissements de santé étrangers et par dérogation à l’article 33 du décret n° 2012-1246 du 7 novembre 2012 relatif à la gestion budgétaire et comptable publique, les dépenses relatives à la mise à disposition des greffons prévues à l’article L. 1418-1 (8°).
