Article R1423-35 of the French Labour Code

Depending on the case, the adjudication committee comprises:

1° In its ordinary composition as referred to in Article L. 1423-12, two councillors representing employers and two councillors representing employees;

2° In its restricted composition referred to in Article L. 1423-13, one employer and one employee councillor;

3° In its composition referred to in 2° of Article L. 1454-1-1, two councillors for male employers, two councillors for male employees and the judge referred to in Article L. 1454-2;

4° For the purposes of deciding between the parties:

a) The panel of the adjudication office referred to in 1° or 2° which has reached a tie, presided over by the judge deciding between the parties;

b) The panel of the conciliation and referral office that has reached an agreement on the division of votes, completed by an employer councillor and an employee councillor and presided over by the deciding judge.

Le bureau de jugement comprend selon les cas :

1° Dans sa composition de droit commun visée à l’article L. 1423-12, deux conseillers prud’hommes employeurs et deux conseillers prud’hommes salariés ;

2° Dans sa composition restreinte visée à l’article L. 1423-13, un conseiller prud’homme employeur et un conseiller prud’homme salarié ;

3° Dans sa composition visée au 2° de l’article L. 1454-1-1, deux conseillers prud’hommes employeurs, deux conseillers prud’hommes salariés et le juge mentionné à l’article L. 1454-2 ;

4° Aux fins de départage :

a) La formation du bureau de jugement mentionnée au 1° ou au 2° qui s’est mise en partage de voix, présidée par le juge départiteur ;

b) La formation du bureau de conciliation et d’orientation qui s’est mise en partage de voix, complétée par un conseiller prud’homme employeur et un conseiller prud’homme salarié et présidée par le juge départiteur.
