Article R1423-4 of the French Labour Code

The Minister for Justice and the Minister for Labour shall set out by order, for each general appointment of industrial tribunal members, the allocation table referred to in Article L. 1423-1-1.

Subject to the provisions relating to the management section, this table assigns each collective agreement or branch collective agreement to the industry, commerce and commercial services, agriculture or miscellaneous activities sections according to their scope of application. In the absence of an applicable collective agreement, the miscellaneous activities section will apply.

This table remains applicable notwithstanding any denunciation or challenge to an agreement or arrangement appearing therein.

Article R1423-4

Le garde des sceaux, ministre de la justice, et le ministre chargé du travail fixent par arrêté, pour chaque désignation générale des conseillers prud’hommes, le tableau de répartition mentionné à l’article L. 1423-1-1.

Sous réserve des dispositions relatives à la section de l’encadrement, ce tableau rattache aux sections de l’industrie, du commerce et des services commerciaux, de l’agriculture ou des activités diverses chaque convention collective ou accord collectif de branche en fonction du champ d’application de ceux-ci. En l’absence de convention ou d’accord collectif applicable, la section de rattachement est celle des activités diverses.

Ce tableau demeure applicable nonobstant toute dénonciation ou mise en cause d’une convention ou d’un accord qui y figure.
