Article R1441-11 of the French Labour Code

In the event of a tie between two or more organisations pursuant to article R. 1441-10, the seat is awarded to the professional organisation with the highest number of member undertakings and employees, each representing 50%, calculated pursuant to article R. 1441-8.

In the event of a tie in application of the previous paragraph, the seat is awarded to the professional organisation with the highest number of member companies and employees, each representing 50% of the total, calculated in application of article R. 1441-8.

En cas d’égalité entre deux ou plusieurs organisations en application de l’article R. 1441-10, le siège est attribué à l’organisation professionnelle dont le nombre d’entreprises adhérentes et de salariés, chacun à hauteur de 50 %, calculé en application de l’article R. 1441-8, est le plus élevé.

En cas d’égalité en application de l’alinéa précédent, le siège est attribué à l’organisation professionnelle dont le nombre d’entreprises adhérentes et de salariés, chacun à hauteur de 50 %, calculé en application de l’article R. 1441-8, est le plus élevé pour l’ensemble des sections.
