Article R1442-22-9 of the French Labour Code

As soon as the matter is referred to the committee, the accused industrial tribunal member is informed of the referral by any means giving a date certain by the committee secretary, who informs him that he may inspect the documents relating to the proceedings at the committee secretariat or that they may be sent to him electronically.

The Chairman of the Committee appoints a rapporteur from among the members of the Committee, who carries out all necessary investigations. The rapporteur shall hear the person concerned and any witnesses. He may have them heard by a judge to whom he has delegated the task.

Dès la saisine de la commission, le conseiller prud’homme mis en cause est informé de cette saisine par tout moyen conférant date certaine par le secrétaire de la commission, qui lui précise qu’il peut prendre connaissance, au secrétariat de la commission, des pièces afférentes à la poursuite, ou qu’elles peuvent lui être communiquées par voie électronique.


Le président de la commission désigne parmi les membres de la commission un rapporteur, qui procède à toutes investigations utiles. Le rapporteur entend l’intéressé et, s’il y a lieu, les témoins. Il peut les faire entendre par un magistrat du siège auquel il donne délégation.
