The compliance officer is appointed, within each of the bodies and authorities mentioned in II of article L. 1451-4, by their chairman, when he has executive functions, failing this by their chief executive, and failing this by their director, and, within the Economic Committee for Health Products, by the ministers with whom it is placed.
The compliance officer is appointed, subject to the provisions specific to each authority or body, either from among the employees of these authorities or bodies, or from among the qualified persons who are members of the committee responsible for professional ethics, if such a committee exists, or from among external persons, after obtaining the opinion of the committee responsible for professional ethics, if such a committee exists. The compliance officer is appointed for a renewable period of three years.
In the performance of his duties, the compliance officer reports only to the person who appointed him.
