Article R1453-3 of the French Public Health Code

I.-For the agreements referred to in 1° of Article R. 1453-2, each company shall make public the following information in addition to its own identity, including its corporate name, its corporate purpose and the address of its registered office:

1° The identity of the parties to each agreement, i.e. :

a) In the case of a healthcare professional, the surname, first name, job title, professional address and, where applicable, the title, speciality or personal identifier in the shared directory of healthcare professionals or, failing this, the registration number with the professional association ;

b) In the case of a student intending to practise one of the professions covered by Part Four of the Code, the surname, first name, name and address of the educational establishment or organisation to which the student is affiliated and, where applicable, the personal identifier in the shared directory of health professionals;

c) In the case of a legal entity: the company name, the corporate purpose and the address of the registered office;

d) In the case of a person referred to in 7° bis of the I of article L. 1453-1, the name under which he carries out his influential activity;

2° The date of signature of the agreement and its expiry date if known at the time of signature;

3° The precise purpose of the agreement according to the thematic typology set out in the order referred to in article R. 1453-4, formulated with due respect for legally protected secrets, in particular business secrets;

4° Where the agreement relates to an event referred to in 4° of Article L. 1453-7, the organiser, name, date and location of the event;

5° The total amount of the agreement.

In order to ensure the traceability of the benefits and remuneration granted, the co-contractors are required to provide the electronic declarant with all the information they are aware of that enables any indirect and final beneficiaries to be identified.

Ia.-For the remuneration referred to in 2° of Article R. 1453-2, each company must make public the following information, in addition to its own identity including its company name, its corporate purpose and the address of its registered office:

1° The identity of each beneficiary in accordance with the procedures set out in 1° of I ;

2° The date and amount, rounded to the nearest euro, of each remuneration paid to beneficiaries during a calendar half-year. The remunerations are made public on each payment due date in accordance with the procedures set out in the agreement;

3° The calendar half-year during which the remuneration was paid.

II.-For the benefits mentioned in 3° of article R. 1453-2, each company makes public the following information, in addition to its own identity including its corporate name, its corporate purpose and the address of its registered office:

1° The identity of the beneficiary in accordance with the procedures set out in 1° of I of this article ;

2° The amount, including all taxes, rounded to the nearest euro, the date and the nature of each benefit received by the beneficiary during a calendar half-year;

3° The calendar half-year during which the benefits were granted.

Article R1453-3

I.-Pour les conventions mentionnées au 1° de l’article R. 1453-2, chaque entreprise rend publiques les informations suivantes en plus de sa propre identité comportant sa dénomination sociale, son objet social et l’adresse du siège social :

1° L’identité des parties à chaque convention, soit :

a) Lorsqu’il s’agit d’un professionnel de santé, le nom, le prénom, la qualité, l’adresse professionnelle et, le cas échéant, le titre, la spécialité ou l’identifiant personnel dans le répertoire partagé des professionnels de santé ou, à défaut, le numéro d’inscription à l’ordre ;

b) Lorsqu’il s’agit d’un étudiant se destinant à l’une des professions relevant de la quatrième partie du code, le nom, le prénom, le nom et l’adresse de l’établissement d’enseignement ou de l’organisme de rattachement et, le cas échéant, l’identifiant personnel dans le répertoire partagé des professionnels de santé ;

c) Lorsqu’il s’agit d’une personne morale : la dénomination sociale, l’objet social et l’adresse du siège social ;

d) Lorsqu’il s’agit d’une personne mentionnée au 7° bis du I de l’article L. 1453-1, la dénomination sous laquelle il exerce son activité d’influence ;

2° La date de signature de la convention et sa date d’échéance si elle est connue au moment de la signature ;

3° L’objet précis de la convention selon la typologie thématique prévue par l’arrêté mentionné à l’article R. 1453-4, formulé dans le respect des secrets protégés par la loi, notamment du secret des affaires ;

4° Lorsque la convention a pour objet une manifestation mentionnée au 4° de l’article L. 1453-7, l’organisateur, le nom, la date et le lieu de la manifestation ;

5° Le montant total de la convention.

Afin d’assurer la traçabilité des avantages et rémunérations consentis, les cocontractants sont tenus de fournir au télédéclarant l’ensemble des informations dont ils ont connaissance permettant d’identifier les éventuels bénéficiaires indirects et finaux.

I bis.-Pour les rémunérations mentionnées au 2° de l’article R. 1453-2, chaque entreprise rend publiques les informations suivantes, en sus de sa propre identité comportant sa dénomination sociale, son objet social et l’adresse du siège social :

1° L’identité de chaque personne bénéficiaire selon les modalités prévues au 1° du I ;

2° La date et le montant arrondi à l’euro le plus proche de chaque rémunération versée aux bénéficiaires au cours d’un semestre civil. Les rémunérations sont rendues publiques à chaque échéance de versement suivant les modalités prévues par la convention ;

3° Le semestre civil au cours duquel les rémunérations ont été versées.

II.-Pour les avantages mentionnés au 3° de l’article R. 1453-2, chaque entreprise rend publiques les informations suivantes, en sus de sa propre identité comportant sa dénomination sociale, son objet social et l’adresse du siège social :

1° L’identité de la personne bénéficiaire selon les modalités prévues au 1° du I du présent article ;

2° Le montant, toutes taxes comprises, arrondi à l’euro le plus proche, la date et la nature de chaque avantage perçu par le bénéficiaire au cours d’un semestre civil ;

3° Le semestre civil au cours duquel les avantages ont été consentis.
