Article R1454-4 of the French Labour Code

The councillor-rapporteur is an industrial tribunal councillor. He may be a member of the judging panel.

When two Conseiller Rapporteurs are appointed in the same case, one is an employer, the other an employee. They carry out their duties together.

The advisor-rapporteur has the powers conferred on the conciliation and referral office. He may, in order to ascertain the truth, interview any person and carry out any investigative measures. He may order any measures necessary to preserve the evidence or objects in dispute.

Le conseiller rapporteur est un conseiller prud’homme. Il peut faire partie de la formation de jugement.

Lorsque deux conseillers rapporteurs sont désignés dans la même affaire, l’un est employeur, l’autre est salarié. Ils procèdent ensemble à leur mission.

Le conseiller rapporteur dispose des pouvoirs de mise en état conférés au bureau de conciliation et d’orientation. Il peut, pour la manifestation de la vérité, auditionner toute personne et faire procéder à toutes mesures d’instruction. Il peut ordonner toutes mesures nécessaires à la conservation des preuves ou des objets litigieux.
