Article R1455-12 of the French Labour Code

Unless otherwise stipulated, when it is provided that the industrial tribunal shall rule on the merits of the case in accordance with the accelerated procedure, the claim shall be brought before a hearing held on the day and at the time set for this purpose, under the conditions provided for in Article R. 1455-9.

It is lodged, investigated and judged under the following conditions:

1° Article 481-1, paragraphs 3 and 7 of the Code of Civil Procedure are applied;

2° The judgement is provisionally enforceable, unless the industrial tribunal decides otherwise, subject to the provisions of the second paragraph of article R. 1454-28.

When the industrial tribunal ruling under the accelerated procedure on the merits is wrongly seised, the case may be referred back to the judgment office under the conditions provided for in Article R. 1455-8.

The panel of the industrial tribunal called upon to rule under the accelerated procedure on the merits is, unless otherwise provided, composed and organised under the conditions defined in articles R. 1455-1 to R. 1455-4.

Article R1455-12

A moins qu’il en soit disposé autrement, lorsqu’il est prévu que le conseil de prud’hommes statue selon la procédure accélérée au fond, la demande est portée à une audience tenue aux jour et heures à cet effet, dans les conditions prévues à l’article R. 1455-9.

Elle est formée, instruite et jugée dans les conditions suivantes :

1° Il est fait application des 3° et 7° de l’article 481-1 du code de procédure civile ;

2° Le jugement est exécutoire à titre provisoire, à moins que le conseil de prud’hommes en décide autrement, sous réserve des dispositions du deuxième alinéa de l’article R. 1454-28.

Lorsque le conseil de prud’hommes statuant selon la procédure accélérée au fond est saisi à tort, l’affaire peut être renvoyée devant le bureau de jugement dans les conditions prévues à l’article R. 1455-8.

La formation du conseil de prud’hommes amenée à statuer selon la procédure accélérée au fond est, sauf disposition contraire, composée et organisée dans les conditions définies aux articles R. 1455-1 à R. 1455-4.
