Article R15-33-18 of the French Code of Criminal Procedure

Customs officers performing judicial police duties pursuant to Article 28-1 are directed as appropriate either by the public prosecutor or by the requesting investigating judge.

On the occasion of a judicial investigation or the execution of a letter rogatory, they may only seek or receive orders or instructions from the judicial authority that requested them.

Les agents des douanes qui exercent des missions de police judiciaire en application de l’article 28-1 sont dirigés selon les cas soit par le procureur de la République, soit par le juge d’instruction requérant.

A l’occasion d’une enquête judiciaire ou de l’exécution d’une commission rogatoire, ils ne peuvent solliciter ou recevoir des ordres ou instructions que de l’autorité judiciaire qui les a requis.
