Article R15-33-29-24 of the French Code of Criminal Procedure

For each judicial environmental officer, a request for authorisation is sent, on the proposal of the Director General of the French Biodiversity Office, to the Public Prosecutor at the Court of Appeal in whose jurisdiction the headquarters of the department to which the judicial environmental officer belongs is located.
Judicial environmental officers may not effectively exercise the powers attached to this status or rely on it unless they are assigned to a post involving such exercise and by virtue of a decision by the public prosecutor at the court of appeal personally authorising them to do so. Any change of post will result in this authorisation lapsing.

Pour chacun des officiers judiciaires de l’environnement, une demande d’habilitation est adressée, sur proposition du directeur général de l’Office français de la biodiversité, au procureur général près la cour d’appel dans le ressort de laquelle se situe le siège du service de rattachement de l’officier judiciaire de l’environnement.


Les officiers judiciaires de l’environnement ne peuvent exercer effectivement les attributions attachées à cette qualité ni se prévaloir de cette dernière que s’ils sont affectés à un emploi comportant cet exercice et en vertu d’une décision du procureur général près la cour d’appel les y habilitant personnellement. Tout changement d’affectation entraîne la caducité de cette habilitation.
