Article R15-33-60-5 of the French Code of Criminal Procedure

If the president of the court issues a validation order, it specifies that the legal entity has a period of ten days to exercise its right of withdrawal by registered letter with acknowledgement of receipt sent to the public prosecutor.

The representatives of the legal entity are also given a document informing them of the conditions under which the obligations laid down must be fulfilled. This document is accompanied, if necessary, by several sheets of paper intended for payment of the public interest fine, the model for which is determined by the Minister for the Budget and the Minister of Justice. It also includes a statement to the effect that if the legal entity fails to provide proof of full compliance with the obligations laid down, the public prosecutor will decide to take legal action against it, unless there are new grounds for doing so.

Si le président du tribunal rend une ordonnance de validation, celle-ci précise que la personne morale dispose d’un délai de dix jours pour exercer son droit de rétractation par lettre recommandée avec demande d’avis de réception adressée au procureur de la République.

Il est également remis aux représentants de la personne morale un document l’informant des conditions dans lesquelles doivent être accomplies les obligations prévues. Ce document est accompagné si nécessaire de plusieurs feuillets destinés à permettre le paiement de l’amende d’intérêt public et dont le modèle est arrêté par le ministre chargé du budget et le garde des sceaux, ministre de la justice. Il comporte également une mention indiquant que si la personne morale ne justifie pas de l’exécution intégrale des obligations prévues, le procureur de la République décidera, sauf élément nouveau, d’engager des poursuites à son encontre.
