Article R15-33-63 of the French Code of Criminal Procedure

If the offender accepts the proposal, the mayor forwards it to the public prosecutor for approval by the competent judicial authority, together with the reports recording the offence.

Where the proposed settlement consists of the performance of unpaid work, the public prosecutor forwards these documents to the judge of the competent police court, together with his or her recommendations regarding approval.

The judicial authority sends the mayor its decision as soon as possible, indicating whether or not it approves the settlement.

En cas d’acceptation de la proposition par le contrevenant, le maire transmet cette dernière au procureur de la République aux fins d’homologation par l’autorité judiciaire compétente, accompagnée des procès-verbaux de constatation de l’infraction.

Lorsque la proposition de transaction consiste en l’exécution d’un travail non rémunéré, le procureur de la République transmet ces documents au juge du tribunal de police compétent, accompagnés de ses réquisitions sur l’homologation.

L’autorité judiciaire adresse au maire dans les meilleurs délais sa décision indiquant si elle homologue ou non la transaction.
