Article R15-35 of the French Code of Criminal Procedure

The natural person or legal entity, depending on whether it wishes to be authorised to carry out personality investigations within the jurisdiction of the judicial court or that of the court of appeal, shall make a request to the doyen of the investigating judges or to the president of the investigating chamber.

The request made by an association shall include in particular:

1° A copy of the Journal officiel publishing the declaration of the association or, as regards the departments of Bas-Rhin, Haut-Rhin or Moselle, a copy of the extract from the register of associations of the judicial court;

2° A copy of the articles of association and, if applicable, the internal rules ;

3° A list of the association’s establishments with an indication of their registered offices;

4° A statement indicating the operating conditions of the association and, where applicable, the organisation and operating conditions of the local committees, as well as their relationship with the association ;

5° A statement of the surnames, first names, date and place of birth, nationality, occupation and domicile of the members of the association’s board of directors and executive committee and, where applicable, those of its local representatives;

6° Financial documents, which must include the accounts for the last financial year, the budget for the current financial year and a balance sheet or statement of movable and immovable assets and liabilities ;

7° A list of the natural persons who, within the association, must carry out the tasks entrusted to it, with a mention of the surname, first names, date and place of birth, nationality, profession and domicile of each of them.

La personne physique ou morale, selon qu’elle désire être habilitée à procéder à des enquêtes de personnalité dans le ressort du tribunal judiciaire ou dans celui de la cour d’appel, en fait la demande au doyen des juges d’instruction ou au président de la chambre de l’instruction.

La demande présentée par une association comporte notamment :

1° La copie du Journal officiel portant publication de la déclaration de l’association ou, en ce qui concerne les départements du Bas-Rhin, du Haut-Rhin ou de la Moselle, une copie de l’extrait du registre des associations du tribunal judiciaire ;

2° Un exemplaire des statuts et, s’il y a lieu, du règlement intérieur ;

3° La liste des établissements de l’association avec indication de leur siège ;

4° Un exposé indiquant les conditions de fonctionnement de l’association et, le cas échéant, l’organisation et les conditions de fonctionnement des comités locaux, ainsi que leurs rapports avec l’association ;

5° La mention des nom, prénoms, date et lieu de naissance, nationalité, profession et domicile des membres du conseil d’administration et du bureau de l’association ainsi que, le cas échéant, ceux de ses représentants locaux ;

6° Les pièces financières qui doivent comprendre les comptes du dernier exercice, le budget de l’exercice courant et un bilan ou un état de l’actif mobilier et immobilier et du passif ;

7° La liste des personnes physiques qui, au sein de l’association, doivent accomplir les missions qui lui sont confiées, avec la mention des nom, prénoms, date et lieu de naissance, nationalité, profession et domicile de chacune d’entre elles.
