Article R1511-58 of the French General Code of Local Authorities

The agreements referred to in the first paragraph of I of article L. 1511-9 are concluded between the veterinary surgeon or veterinary practice company receiving the aid and the local authority or authorities or their groupings which grant the aid.

They specify, in particular, the commitments made by the beneficiary in return for the aid granted, which must include the commitment:

a) To carry out his activity and, where applicable, to establish a professional domicile for practice, on the territory of the territorial authority or authorities or groupings which grant the aid, for a minimum period of three years;

b) To ensure the continuity and permanence of farm animal care as defined in articles R. 242-48 and R. 242-61 du même code. If the beneficiary of the aid uses a day-care service, the agreement provided for in article R. 242-61 of this code provides for the direct participation of the beneficiary in this service;

c) To repay all or part of the aid received in the event of non-compliance with its commitments or the impossibility of meeting them. The amount of aid to be repaid is calculated pro rata to the time during which the commitments were not met.

Les conventions mentionnées au premier alinéa du I de l’article L. 1511-9 sont conclues entre le vétérinaire ou la société d’exercice vétérinaire bénéficiaire des aides et la ou les collectivités territoriales ou leurs groupements qui attribuent les aides.

Elles précisent notamment les engagements pris par le bénéficiaire en contrepartie des aides accordées, qui incluent obligatoirement l’engagement :

a) D’exercer son activité et, le cas échéant, d’établir un domicile professionnel d’exercice, sur le territoire de la ou des collectivités territoriales ou groupements qui attribuent les aides, pour une période minimale de trois ans ;

b) D’assurer la continuité et la permanence des soins des animaux d’élevage définies aux articles R. 242-48 et R. 242-61 du même code. Dans le cas où le bénéficiaire de l’aide recourt à un service de garde, la convention prévue à l’article R. 242-61 de ce code prévoit la participation directe du bénéficiaire à ce service ;

c) De restituer tout ou partie des aides perçues en cas de non-respect de ses engagements ou d’impossibilité de tenir ces derniers. Le montant des aides devant être restitué est calculé au prorata du temps pendant lequel les engagements n’ont pas été tenus.
