Article R1614-109 of the French General Code of Local Authorities

The amount of the contribution that, pursuant to the third paragraph of Article L. 1614-8-1 the State pays to each region for the operation of the transferred services is equal to the sum necessary to ensure the balance of the SNCF’s certified account, for the 2000 financial year, relating to the regional passenger services of that region, excluding non-recurring charges and after deduction of the region’s own contribution as determined below:

a) The own contribution of a region which participated in the experiment provided for by Article 67 of the law of 4 February 1995 on regional planning and development corresponds to the amount of financial support from the region to the SNCF, shown in the certified account for the financial year 2000, from which is deducted the allocation from the State to the region for operations in the first year of experimentation, this allocation being updated in 2000 francs by applying the forecast price index of the market gross domestic product.

The amount of the State grant to the region for operations in the first year of the experiment is equal to the difference between the region’s financial assistance to SNCF in the first year of the experiment and the region’s own effort, as determined by the audit prior to the experiment and updated in francs for the first year of the experiment by applying the forecast price index for gross domestic product;

b) For the other regions, the region’s own contribution, mentioned in the first paragraph of this article, corresponds to the region’s financial assistance to the SNCF, shown in the certified account for the 2000 financial year.

Le montant de la contribution qu’en application du troisième alinéa de l’article L. 1614-8-1 l’Etat verse à chaque région pour l’exploitation des services transférés est égal à la somme nécessaire pour assurer l’équilibre du compte attesté de la SNCF, au titre de l’exercice 2000, relatif aux services régionaux de voyageurs de cette région, à l’exclusion des charges non récurrentes et après déduction de la contribution propre de la région telle que déterminée ci-après :

a) La contribution propre d’une région qui a participé à l’expérimentation prévue par l’article 67 de la loi du 4 février 1995 d’orientation pour l’aménagement et le développement du territoire correspond au montant des concours financiers de la région à la SNCF, figurant au compte attesté de l’exercice 2000, dont est déduite la dotation de l’Etat à la région au titre de l’exploitation la première année d’expérimentation, cette dotation étant actualisée en francs 2000 par application de l’indice prévisionnel des prix du produit intérieur brut marchand.

Le montant de la dotation de l’Etat à la région au titre de l’exploitation la première année d’expérimentation est égal à la différence entre les concours financiers de la région à la SNCF la première année de l’expérimentation et l’effort propre de la région, constaté par l’audit préalable à l’expérimentation et actualisé en francs de la première année de l’expérimentation par application de l’indice prévisionnel des prix du produit intérieur brut marchand ;

b) Pour les autres régions, la contribution propre de la région, mentionnée au premier alinéa du présent article, correspond aux concours financiers de la région à la SNCF, figurant au compte attesté de l’exercice 2000.
