Article R1614-75 of the French General Code of Local Authorities

The special contribution relating to municipal and inter-communal libraries and departmental libraries provided for by article L. 1614-10 comprises two fractions:

– the first fraction is intended to contribute to the financing of investments and non-permanent operating expenditure for the benefit of municipal and inter-municipal libraries and departmental libraries. The amount of the appropriations for this fraction corresponds to the difference between the total amount of the special assistance and the amount of the appropriations for the second fraction;

– the purpose of the second fraction is to contribute to the financing of investments and non-permanent operating expenditure for the benefit of municipal and inter-municipal libraries and departmental libraries likely to have a departmental or regional influence as defined in the second paragraph of the article R. 1614-88. The amount of appropriations in this fraction is calculated by applying to the total amount of special assistance a rate determined each year by joint order of the Minister of the Interior and the Minister responsible for culture and no more than 15%.

Main, sector and annex municipal and inter-communal libraries, as well as main and annex departmental libraries, are eligible for special assistance.

For the purposes of this sub-section, in the context of the public reading network of a local authority or group of local authorities, the library at the head of the network is referred to as the main library; libraries that are dependent on another library are referred to as branch libraries; libraries that are neither main nor branch libraries are referred to as sector libraries.

Le concours particulier relatif aux bibliothèques municipales et intercommunales et aux bibliothèques départementales prévu par l’article L. 1614-10 comporte deux fractions :

– la première fraction a pour objet de contribuer au financement des investissements et des dépenses de fonctionnement non pérennes au profit des bibliothèques municipales et intercommunales et des bibliothèques départementales . Le montant des crédits de cette fraction correspond à la différence entre le montant total du concours particulier et le montant des crédits de la seconde fraction ;

– la seconde fraction a pour objet de contribuer au financement des investissements et des dépenses de fonctionnement non pérennes au profit des bibliothèques municipales et intercommunales et des bibliothèques départementales susceptibles d’exercer un rayonnement départemental ou régional tel que défini au second alinéa de l’article R. 1614-88. Le montant des crédits de cette fraction est calculé en appliquant au montant total du concours particulier un taux déterminé chaque année par arrêté conjoint du ministre de l’intérieur et du ministre chargé de la culture et au plus égal à 15 %.

Sont éligibles au concours particulier les bibliothèques municipales et intercommunales principales, de secteur et annexes, ainsi que les bibliothèques départementales principales et annexes.

Pour l’application de la présente sous-section, dans le cadre du réseau de lecture publique d’une collectivité territoriale ou d’un groupement de collectivités territoriales, est dite principale la bibliothèque qui est à la tête du réseau ; sont dites bibliothèques annexes, les bibliothèques qui dépendent d’une autre bibliothèque ; sont dites bibliothèques de secteur, les bibliothèques qui ne sont ni principales, ni annexes.
