Article R1614-79 of the French General Code of Local Authorities

Investments for the purpose of building, renovating, restructuring or making accessible as provided for in articles L. 111-7 to L. 111-7-4 of the Code de la construction et de l’habitation for the benefit of main or sector municipal and inter-communal libraries can only be taken into account if the built area, renovated area or total area after works reaches 100 square metres and if it is at least equal to an area determined as follows:

a) Where the population of the municipality or public establishment for inter-municipal cooperation does not exceed 25,000 inhabitants, the minimum surface area is equal to 0.07 square metres per inhabitant ;

b) Where the population of the municipality or public establishment for inter-municipal cooperation exceeds 25,000 inhabitants, the minimum surface area results from the sum of the product of the fraction of the population less than or equal to 25,000 inhabitants by the coefficient 0.07, and the product of the fraction of the population greater than 25,000 inhabitants by the coefficient 0.015 ;

c) For the municipalities and public establishments for inter-municipal cooperation in the overseas departments and Saint-Pierre-et-Miquelon, the coefficient 0.07 provided for in a and b is reduced to 0.05 ;

d) When construction or restructuring investments have a surface area of more than 8,000 square metres, they may be taken into account regardless of the population of the municipality or public establishment for inter-municipal cooperation;

e) For the municipalities of Paris, Lyon and Marseille, the population to be taken into account for the application of this article is that of the arrondissement or arrondissements served ;

f) When the operation is provided by a public establishment for inter-communal cooperation, the population to be taken into account for the application of this article is that of the area served by the library, as defined by the deliberative body of the local authority.

Investments to extend main or sector municipal and inter-communal libraries are subject only to the condition that the total surface area of the library after extension is at least equal to the minimum surface area determined under the conditions provided for in this article.

Les investissements ayant pour objet la construction, la rénovation, la restructuration ou la mise en accessibilité prévu par les articles L. 111-7 à L. 111-7-4 du code de la construction et de l’habitation au profit des bibliothèques municipales et intercommunales principales ou de secteur ne peuvent être pris en compte que si la surface construite, la surface rénovée ou la surface totale après travaux atteint 100 mètres carrés et si elle est au moins égale à une surface déterminée de la manière suivante :

a) Lorsque la population de la commune ou de l’établissement public de coopération intercommunale n’excède pas 25 000 habitants, la surface minimale est égale à 0,07 mètre carré par habitant ;

b) Lorsque la population de la commune ou de l’établissement public de coopération intercommunale est supérieure à 25 000 habitants, la surface minimale résulte de la somme du produit de la fraction de la population inférieure ou égale à 25 000 habitants par le coefficient 0,07, et du produit de la fraction de la population supérieure à 25 000 habitants par le coefficient 0,015 ;

c) Pour les communes et les établissements publics de coopération intercommunale des départements d’outre-mer et de Saint-Pierre-et-Miquelon, le coefficient 0,07 prévu aux a et b est ramené à 0,05 ;

d) Lorsque les investissements de construction ou de restructuration ont une surface supérieure à 8 000 mètres carrés, elles peuvent être retenues quelle que soit la population de la commune ou de l’établissement public de coopération intercommunale ;

e) Pour les communes de Paris, de Lyon et de Marseille, la population à prendre en compte pour l’application du présent article est celle du ou des arrondissements desservis ;

f) Lorsque l’opération est assurée par un établissement public de coopération intercommunale, la population à prendre en compte pour l’application du présent article est celle de la zone desservie par la bibliothèque, définie par l’organe délibérant de la collectivité.

Les investissements d’extension de bibliothèques municipales et intercommunales principales ou de secteur ne sont soumises qu’à la condition que la surface totale de la bibliothèque après extension soit au moins égale à la surface minimale déterminée dans les conditions prévues au présent article.
