Article R211-18-3 of the French Sports Code

I. – The draft budget is sent by the Director General to the Ministers for Sport and the Budget at least fifteen days before it is presented to the Board of Directors of the institution.

II. – The Board of Directors votes for the budget to be in real balance.

III. – At the meeting of the Board of Directors, the Director of Sport may decide that the budget is subject to approval by the Minister for Sport and the Minister for the Budget in the following cases:

1° The draft budget has not been communicated within the timeframe set out in I;

2° The budget does not balance in real terms;

3° The budget does not include the appropriations required to meet the obligations and commitments of the establishment;

4° The employment ceiling set by the State is not respected.

IV. – In the event that the budget is not subject to approval in application of III, it is enforceable from the time it is communicated to the Minister responsible for Sport.

V. – If the budget is subject to approval in application of III, approval is deemed to have been granted if it is not refused within one month of the budget deliberations being forwarded to the competent ministers.

If approval is refused, the Board of Directors shall deliberate again on the budget within one month of being notified of the refusal. The new deliberation is subject to approval.

If no new deliberation takes place within one month, or if the irregularities that led to the refusal of approval have not been remedied by the new deliberation, the budget is approved by the Minister for Sport and the Minister for the Budget.

I. – Le projet de budget est communiqué par le directeur général aux ministres chargés des sports et du budget quinze jours au moins avant sa présentation au conseil d’administration de l’établissement.

II. – Le conseil d’administration vote le budget en équilibre réel.

III. – Lors de la séance du conseil d’administration, le directeur des sports peut décider que le budget est soumis à l’approbation du ministre chargé des sports et du ministre chargé du budget dans les cas suivants :

1° Le projet de budget n’a pas été communiqué dans le délai fixé au I ;

2° Le budget n’est pas en équilibre réel ;

3° Le budget ne prévoit pas les crédits nécessaires au respect des obligations et des engagements de l’établissement ;

4° Le plafond d’emplois fixé par l’Etat n’est pas respecté.

IV. – Dans le cas où le budget n’est pas soumis à approbation en application du III, il est exécutoire à compter de sa communication au ministre chargé des sports.

V. – Dans le cas où le budget est soumis à approbation en application du III, celle-ci est réputée acquise si elle n’est pas refusée dans le délai d’un mois suivant la transmission de la délibération budgétaire aux ministres compétents.

En cas de refus d’approbation, le conseil d’administration délibère à nouveau sur le budget dans le délai d’un mois suivant la notification du refus. La nouvelle délibération est soumise à approbation.

A défaut de nouvelle délibération dans le délai d’un mois, ou s’il n’a pas été remédié par la nouvelle délibération aux irrégularités ayant motivé le refus d’approbation, le budget est arrêté par le ministre chargé des sports et le ministre chargé du budget.
