Article R212-47 of the French Cinema and Moving Image Code

The reference price mentioned in article L. 212-28, to which the exhibitor issuing the formula commits, serves as the basis for remuneration of distributors with whom it concludes contracts for the granting of cinematographic representation rights, as well as for remuneration of rights holders. This price may be indexed.
The President of the Centre national du cinéma et de l’image animée verifies, in particular by means of the economic data mentioned in article R. 212-55, that this price has been determined in accordance with the criteria mentioned in article L. 212-28.

Le prix de référence mentionné à l’article L. 212-28, sur lequel s’engage l’exploitant émetteur de la formule, sert d’assiette à la rémunération des distributeurs avec lesquels il conclut des contrats de concession de droits de représentation cinématographique, ainsi qu’à la rémunération des ayants droit. Ce prix peut faire l’objet d’une indexation.
Le président du Centre national du cinéma et de l’image animée vérifie, notamment au moyen des données économiques mentionnées à l’article R. 212-55, que ce prix a été déterminé conformément aux critères mentionnés à l’article L. 212-28.
