Article R2122-1 of the French Public procurement code

The purchaser may award a contract without prior publicity or competitive tendering when, due to compelling urgency resulting from external circumstances and which it could not foresee, it is not possible to comply with the minimum time limits required by the formalised procedures.
This is particularly the case for contracts made necessary for the urgent, compulsory execution of the work mentioned in article L. 1311-4 of the Public Health Code and Articles L. 184-1, L. 511-11, L. 511-15, L. 511-16 and L. 511-19 to L. 511-21 of the Building and Housing Code, as well as contracts awarded to deal with health hazards defined in 1° and 2° of Article L. 201-1 of the Rural and Maritime Fishing Code.
The contract is limited to the services strictly necessary to deal with the emergency situation.

L’acheteur peut passer un marché sans publicité ni mise en concurrence préalables lorsqu’une urgence impérieuse résultant de circonstances extérieures et qu’il ne pouvait pas prévoir ne permet pas de respecter les délais minimaux exigés par les procédures formalisées.
Tel est notamment le cas des marchés rendus nécessaires pour l’exécution d’office, en urgence, des travaux mentionnés à l’article L. 1311-4 du code de la santé publique et aux articles L. 184-1, L. 511-11, L. 511-15, L. 511-16 et L. 511-19 à L. 511-21 du code de la construction et de l’habitation ainsi que des marchés passés pour faire face à des dangers sanitaires définis aux 1° et 2° de l’article L. 201-1 du code rural et de la pêche maritime.
Le marché est limité aux prestations strictement nécessaires pour faire face à la situation d’urgence.
