Article R2122-11 of the French Public procurement code

A contracting entity may award a contract without prior advertising or competitive tendering:
1° For the purposes of research, experimentation, study or development, without the objective of profitability or amortisation of research and development costs. The award of such a contract must not prejudice the competitive tendering of subsequent contracts which pursue the same objectives;
2° The object of which is the purchase of supplies which can be acquired by taking advantage of a particularly advantageous opportunity which arises within a very short period of time and for which the price to be paid is considerably lower than the prices normally charged on the market.

Article R2122-11

Une entité adjudicatrice peut passer un marché sans publicité ni mise en concurrence préalables :
1° A des fins de recherche, d’expérimentation, d’étude ou de développement, sans objectif de rentabilité ou d’amortissement des coûts de recherche et de développement. La passation d’un tel marché ne doit pas porter préjudice à la mise en concurrence des marchés ultérieurs qui poursuivent ces mêmes objectifs ;
2° Ayant pour objet l’achat de fournitures qu’il est possible d’acquérir en profitant d’une occasion particulièrement avantageuse qui se présente dans une période de temps très courte et pour lesquelles le prix à payer est considérablement plus bas que les prix normalement pratiqués sur le marché.
