Article R2122-2 of the French Public procurement code

The purchaser may award a contract without prior advertising or competitive tendering where, in the cases defined below, either no applications or no tenders have been submitted within the prescribed time limits, or only inadmissible applications as defined in Article R. 2144-7 or unsuitable tenders as defined in Article L. 2152-4 have been submitted, and provided that the initial terms of the contract are not substantially altered:

1° Invitation to tender launched by a contracting authority ;

2° Formalised procedure launched by a contracting entity;

3° A contract meeting a need whose estimated value is below the formalised procedure thresholds;

4° Contracts covered by 3° of article R. 2123-1.

In the cases mentioned in 1° and 2° of this article and in 3° of article R. 2123-1 meeting a need whose estimated value is equal to or greater than the European threshold applicable to these contracts set out in a notice annexed to this code, a report shall be sent to the European Commission if it so requests.

Article R2122-2

L’acheteur peut passer un marché sans publicité ni mise en concurrence préalables lorsque, dans les cas définis ci-après, soit aucune candidature ou aucune offre n’a été déposée dans les délais prescrits, soit seules des candidatures irrecevables définies à l’article R. 2144-7 ou des offres inappropriées définies à l’article L. 2152-4 ont été présentées, et pour autant que les conditions initiales du marché ne soient pas substantiellement modifiées :

1° Appel d’offres lancé par un pouvoir adjudicateur ;

2° Procédure formalisée lancée par une entité adjudicatrice ;

3° Marché répondant à un besoin dont la valeur estimée est inférieure aux seuils de procédure formalisée ;

4° Marché relevant du 3° de l’article R. 2123-1.

Dans les cas mentionnés aux 1° et 2° du présent article et au 3° de l’article R. 2123-1 répondant à un besoin dont la valeur estimée est égale ou supérieure au seuil européen applicable à ces marchés figurant dans un avis annexé au présent code, un rapport est communiqué à la Commission européenne si elle le demande.
