Article R2131-39 of the French Public Health Code

The practitioner’s accreditation may be withdrawn in the event of a breach of the legislative and regulatory requirements of this chapter or a breach of the conditions laid down in the accreditation, as well as in the event of insufficient quality of results with regard to the criteria set by the Director General of the Agence de la biomédecine, after obtaining the opinion of the Orientation Board.

In an emergency, approval may be suspended for a maximum period of three months.

The reasoned decision to suspend or withdraw approval is taken by the Director General of the Agence de la biomédecine. The practitioner is invited to present his/her observations.

The Director General of the Agency shall inform the practitioner of this decision, the competent regional health agency and the health establishment and laboratory where the practitioner practises.

Le retrait de l’agrément du praticien est encouru en cas de violation des prescriptions législatives et réglementaires du présent chapitre ou de violation des conditions fixées par l’agrément, ainsi qu’en cas d’insuffisance de qualité des résultats au regard des critères fixés par le directeur général de l’Agence de la biomédecine, après avis du conseil d’orientation.

En cas d’urgence, l’agrément peut, à titre conservatoire, être suspendu pour une durée maximale de trois mois.

La décision motivée de suspension ou de retrait est prise par le directeur général de l’Agence de la biomédecine. Le praticien est invité à présenter ses observations.

Le directeur général de l’agence informe de cette décision le praticien, l’agence régionale de santé compétente, ainsi que l’établissement de santé et le laboratoire où le praticien exerce.
