When the provisions of the third paragraph of Article L. 6122-10 relating to renewal of authorisation are applied, the application is submitted as provided for in Article R. 6122-28. In this case, the authorisation holder sends a copy of the application to the Director General of the Agence de la biomédecine.

When the provisions of the last paragraph of Article L. 6122-13 relating to the continued suspension or withdrawal of the authorisation are applied, the Director General of the Regional Health Agency will seek the opinion of the Agence de la biomédecine. If the Agence de la biomédecine does not give its opinion within fifteen days of being consulted by the Director General of the Regional Health Agency, this will constitute acceptance of the measure proposed by the latter.

Lorsqu’il est fait application des dispositions du troisième alinéa de l’article L. 6122-10 relatives au renouvellement d’autorisation, la demande est déposée comme il est prévu à l’article R. 6122-28. Dans ce cas, le titulaire de l’autorisation adresse un exemplaire de sa demande au directeur général de l’Agence de la biomédecine.

Lorsqu’il est fait application des dispositions du dernier alinéa de l’article L. 6122-13 relatives au maintien de la suspension ou de retrait de l’autorisation, le directeur général de l’agence régionale de santé recueille l’avis de l’Agence de la biomédecine. L’absence d’avis de l’Agence de la biomédecine dans les quinze jours qui suivent la consultation du directeur général de l’agence régionale de santé vaut acceptation de la mesure proposée par ce dernier.
