Article R214-15-1 of the French Monetary and Financial Code

A UCITS may enter into the financial contracts provided for in 5° of the I of Article L. 214-20 and entered into on the markets mentioned in 1°, 2° or 3° of the I of Article R. 214-11 or traded over-the-counter, provided that, overall, the exposure to the underlying assets does not exceed the investment limits provided for in Articles R. 214-21, R. 214-24 and R. 214-25.

When these financial contracts are based on indices meeting the conditions defined in I of article R. 214-16, the provisions of the first paragraph may be waived.

Article R214-15-1

Un OPCVM peut conclure les contrats financiers prévus au 5° du I de l’article L. 214-20 et conclus sur les marchés mentionnés aux 1°, 2° ou 3° du I de l’article R. 214-11 ou négociés de gré à gré, sous réserve que, globalement, l’exposition aux actifs sous-jacents n’excède pas les limites d’investissement prévues aux articles R. 214-21, R. 214-24 et R. 214-25.

Lorsque ces contrats financiers sont fondés sur des indices répondant aux conditions définies au I de l’article R. 214-16, il peut être dérogé aux dispositions du premier alinéa.
