Article R2141-38 of the French Public Health Code

Artificial insemination, the use of gametes or germ tissue collected, retrieved or preserved for the purposes of medically assisted procreation in application of articles L. 2141-2, L. 2141-11 and L. 2141-12, as well as the embryo transfer referred to in article L. 2141-1, may be carried out:

1° Up to her forty-fifth birthday in the woman, unmarried or within the couple, who is intended to bear the child;

2° Until her sixtieth birthday for the member of the couple who is not intended to bear the child.

L’insémination artificielle, l’utilisation de gamètes ou de tissus germinaux recueillis, prélevés ou conservés à des fins d’assistance médicale à la procréation en application des articles L. 2141-2, L. 2141-11 et L. 2141-12, ainsi que le transfert d’embryons mentionné à l’article L. 2141-1, peuvent être réalisés :


1° Jusqu’à son quarante-cinquième anniversaire chez la femme, non mariée ou au sein du couple, qui a vocation à porter l’enfant ;


2° Jusqu’à son soixantième anniversaire chez le membre du couple qui n’a pas vocation à porter l’enfant.
