Article R2141-39 of the French Public Health Code

The collection, retrieval and storage of gametes, as provided for in article L. 2141-12, are preceded by at least one interview with the multidisciplinary clinical-biological medical team, the composition of which is laid down in article R. 2142-18.

These interviews are used in particular to inform the person of:

1° The legislative and regulatory provisions relating to self-preservation set out in article L. 2141-12;

2° The methods by which this person will be regularly consulted on the fate of gametes preserved for his or her benefit, in accordance with II of article L. 2141-12;

3° The assessment of the chances that procreation can be achieved using gametes preserved for his or her benefit;

4° In the light of current scientific knowledge, the side-effects and short and long-term risks of medically assisted procreation techniques, including the hardship and constraints they may entail.

Le recueil, le prélèvement et la conservation des gamètes, prévus à l’article L. 2141-12, sont précédés d’au moins un entretien avec l’équipe médicale clinico-biologique pluridisciplinaire dont la composition est fixée à l’article R. 2142-18.


Ces entretiens permettent notamment d’informer la personne :


1° Des dispositions législatives et réglementaires relatives à l’autoconservation prévues à l’article L. 2141-12 ;


2° Des modalités selon lesquelles cette personne sera régulièrement consultée sur le devenir des gamètes conservés, à son bénéfice, conformément au II de l’article L. 2141-12 ;


3° De l’évaluation des chances qu’une procréation puisse être réalisée à partir des gamètes conservés à son bénéfice ;


4° En l’état des connaissances scientifiques, des effets secondaires et des risques à court et à long termes des techniques d’assistance médicale à la procréation, y compris de la pénibilité et des contraintes qu’elles peuvent entraîner.
