Article R2142-2 of the French Public Health Code

Without prejudice to compliance with the conditions defined in 1° and 2° of Article L. 6122-2, the granting or renewal of authorisation to carry out one or more of the clinical or biological activities of medically assisted procreation defined in Article R. 2142-1 is subject to compliance with the operating rules laid down in this chapter in application of the fourth paragraph of Article L. 2142-1. These rules constitute the technical operating conditions referred to in 3° of Article L. 6122-2.

When a health establishment, organisation or health cooperation grouping has several sites, the authorisation specifies the site or sites where the activity or activities are carried out. The authorisation issued to a medical biology laboratory specifies the location of the premises dedicated to this activity.

If the requirements of the authorisation are not complied with, the authorisation may be suspended or withdrawn in accordance with the provisions of article L. 6122-13.

Article R2142-2

Sans préjudice du respect des conditions définies aux 1° et 2° de l’article L. 6122-2, l’octroi ou le renouvellement de l’autorisation de pratiquer une ou plusieurs des activités cliniques ou biologiques d’assistance médicale à la procréation définies à l’article R. 2142-1, est subordonné au respect des règles de fonctionnement fixées au présent chapitre en application du quatrième alinéa de l’article L. 2142-1. Ces règles constituent les conditions techniques de fonctionnement mentionnées au 3° de l’article L. 6122-2.

Lorsqu’un établissement de santé, un organisme ou un groupement de coopération sanitaire comporte plusieurs sites, l’autorisation précise le ou les sites d’exercice de la ou des activités. L’autorisation délivrée à un laboratoire de biologie médicale précise le lieu où sont implantés les locaux consacrés à cette activité.

En cas de méconnaissance des prescriptions de l’autorisation, la suspension ou le retrait de cette autorisation peut intervenir conformément aux dispositions de l’article L. 6122-13.
