Article R2143-20 of the French Public Health Code

I.-Persons born of medically assisted procreation with a third-party donor shall receive, when their application is submitted, the information provided for in Article 13 of Regulation (EU) 2016/679 of 27 April 2016, as well as information on the limitations of their rights provided for in III.

Pursuant to Article 14(5)(b) and (c) of Regulation (EU) 2016/679 of 27 April 2016, the information requirement does not apply to recipients of medically assisted procreation with a third-party donor and third-party donors. The Commission shall make the information mentioned in Article 14 of the aforementioned Regulation available on its website and shall provide individual information to third-party donors who have contacted it or whom it has contacted pursuant to Article R. 2143-7.

II – Persons whose data is processed may exercise their right of access to data concerning them, to the exclusion of any personal data relating to another natural person, and their right of rectification, provided for respectively in Articles 15 and 16 of Regulation (EU) 2016/679 of 27 April 2016, by contacting the Secretary General of the Commission.

III – Pursuant to Article 23(1)(e) and (i) of Regulation (EU) 2016/679 of 27 April 2016, the right to erasure of data, the right to restriction and the right to object, provided for respectively in Articles 17, 18 and 21 of the same Regulation, do not apply to this processing.

I.-Les personnes nées d’une assistance médicale à la procréation avec tiers donneur reçoivent, lors du dépôt de leur demande, l’information prévue à l’article 13 du règlement (UE) 2016/679 du 27 avril 2016, ainsi que l’information sur les limitations de leurs droits prévues au III.

En application des b et c du 5 de l’article 14 du règlement (UE) 2016/679 du 27 avril 2016, l’exigence d’information n’est pas applicable aux bénéficiaires d’une assistance médicale à la procréation avec tiers donneur et aux tiers donneurs. La commission met à disposition sur son site internet les éléments mentionnés à l’article 14 du règlement précité et assure l’information individuelle des tiers donneurs qui se sont adressés à elle ou que celle-ci a contactés en application de l’article R. 2143-7.

II.-Les personnes dont les données sont traitées peuvent exercer leur droit d’accès aux données les concernant, à l’exclusion de toute donnée à caractère personnel relative à une autre personne physique, et leur droit de rectification, respectivement prévus aux articles 15 et 16 du règlement (UE) 2016/679 du 27 avril 2016, auprès du secrétaire général de la commission.

III.-En application du e et du i du 1 de l’article 23 du règlement (UE) 2016/679 du 27 avril 2016, le droit à l’effacement des données, le droit à la limitation et le droit d’opposition, respectivement prévus aux articles 17,18 et 21 du même règlement, ne s’appliquent pas à ce traitement.
