Article R2143-4 of the French Public Health Code

Third party donors of gametes or embryos, as defined in article L. 2143-1 and in 1° of article R. 2143-1, consent, for each donation, to the communication of their identity and their non-identifying data mentioned in article L. 2143-3 as part of the pre-donation interviews mentioned in articles R. 1244-2 and R. 2141-2, using a consent form, the model for which is laid down by order of the Minister for Health, after obtaining the opinion of the Agence de la biomédecine.

Once this consent has been obtained by the organisation or health establishment mentioned in the third paragraph of article L. 2142-1, the third-party donors communicate the data mentioned in the first paragraph, under the conditions set out in article R. 2143-5.

The donation may then proceed.

The consent form mentioned in the first paragraph is kept by the organisation or health establishment mentioned in the third paragraph of article L. 2142-1 which received the donation.

Article R2143-4

Les tiers donneurs de gamètes ou d’embryons, tels que définis à l’article L. 2143-1 ainsi qu’au 1° de l’article R. 2143-1, consentent, pour chaque don, à la communication de leur identité et de leurs données non identifiantes mentionnées à l’article L. 2143-3 dans le cadre des entretiens préalables au don mentionnés aux articles R. 1244-2 et R. 2141-2, au moyen d’un formulaire de consentement dont le modèle est fixé par arrêté du ministre chargé de la santé pris après avis de l’Agence de la biomédecine.

Une fois ce consentement recueilli par l’organisme ou l’établissement de santé mentionné au troisième alinéa de l’article L. 2142-1, les tiers donneurs communiquent, dans les conditions prévues à l’article R. 2143-5, les données mentionnées au premier alinéa.

Il peut alors être procédé au don.

Le formulaire de consentement mentionné au premier alinéa est conservé par l’organisme ou l’établissement de santé mentionné au troisième alinéa de l’article L. 2142-1 qui a recueilli le don.
