In the consultation documents, the purchaser may require tenderers to provide a test report from an accredited conformity assessment body as proof of compliance with the technical specifications, award criteria or contract performance conditions, in accordance with Regulation (EC) No 765/2008 of the European Parliament and of the Council of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Council Regulation (EEC) No 339/93, or a certificate issued by such a body. Where it requires a certificate drawn up by an identified assessment body, it will accept a certificate drawn up by an equivalent body.
Where an economic operator does not have access to the certificates or test reports mentioned in the previous paragraph or the possibility of obtaining them within the time limits set by the purchaser, the latter will accept other appropriate means of proof.

Dans les documents de la consultation, l’acheteur peut exiger que les soumissionnaires fournissent, comme moyen de preuve de la conformité aux spécifications techniques, aux critères d’attribution ou aux conditions d’exécution du marché, un rapport d’essai d’un organisme d’évaluation de la conformité accrédité, conformément au règlement (CE) n° 765/2008 du Parlement européen et du Conseil du 9 juillet 2008 fixant les prescriptions relatives à l’accréditation et à la surveillance du marché pour la commercialisation des produits et abrogeant le règlement (CEE) n° 339/93 du Conseil, ou un certificat délivré par un tel organisme. Lorsqu’il exige un certificat établi par un organisme d’évaluation identifié, il accepte un certificat établi par un organisme équivalent.
Lorsqu’un opérateur économique n’a pas accès aux certificats ou aux rapports d’essai mentionnés à l’alinéa précédent ni la possibilité de les obtenir dans les délais fixés par l’acheteur, ce dernier accepte d’autres moyens de preuve appropriés.
