Article R2151-15 of the French Public procurement code

In the consultation documents, the purchaser may require tenders to be accompanied by samples, mock-ups or prototypes as well as any document enabling the tender to be assessed. Where such requests involve a significant investment for tenderers, they give rise to the payment of a premium. The amount of the premium is indicated in the consultation documents. This amount is deducted from the contract holder’s remuneration.

Dans les documents de la consultation, l’acheteur peut exiger que les offres soient accompagnées d’échantillons, de maquettes ou de prototypes ainsi que de tout document permettant d’apprécier l’offre. Lorsque ces demandes impliquent un investissement significatif pour les soumissionnaires, elles donnent lieu au versement d’une prime. Le montant de la prime est indiqué dans les documents de la consultation. Ce montant est déduit de la rémunération du titulaire du marché.
