Article R216 of the French Code of Criminal Procedure

In addition to the reimbursement of their travel expenses, calculated in accordance with the conditions laid down for travel by civil servants for the Ministry of Justice, each person appointed as an ad hoc administrator, where they are on the list provided for in l’article R. 53 or that the provisions of article R. 53-6, for all costs incurred in defending the interests of a minor victim of compensation, the amounts of which Iaah1 to Iaah11 are set by joint order of the Minister for the Budget and the Minister for Justice, according to the following distinctions:

1° For an investigation that has not been followed by a preparatory investigation when the appointment of the ad hoc administrator has been made by the public prosecutor: Iaah1;

2° For a correctional investigation when the facts gave rise to the opening of an investigation before the investigating judge: Iaah2;

3° For a criminal investigation when the facts gave rise to the opening of an investigation before the investigating judge: Iaah3;

4° For a function of accompanying the minor to a correctional court hearing: Iaah4;

5° For a function of accompanying the minor to a hearing of the assize court: Iaah5;

6° For a function of accompanying the minor to a hearing of the juvenile court ruling on correctional matters: Iaah6;

7° For a function of accompanying the minor to a hearing of the juvenile court ruling in criminal matters: Iaah7;

8° For representing the minor when the ad hoc administrator appeals to the criminal appeals chamber or the special chamber for minors: Iaah8;

9° For the representation of the minor when the ad hoc administrator appeals to the assize court ruling on appeal: Iaah9;

10° For an indemnity for failure to act in the event of difficulties in the course of the ad hoc administrator’s assignment, on the basis of a report indicating the diligence accomplished, under the conditions defined in l’article R. 53-8 : Iaah10.

En sus du remboursement de ses frais de déplacement, calculés dans les conditions fixées pour les déplacements des personnels civils de l’Etat pour le ministère de la justice, il est alloué à chaque personne désignée en qualité d’administrateur ad hoc, lorsqu’elle figure sur la liste prévue à l’article R. 53 ou qu’il a été fait application des dispositions de l’article R. 53-6, pour l’ensemble des frais exposés pour la défense des intérêts d’une victime mineure des indemnités, dont les montants Iaah1 à Iaah11 sont fixés par arrêté conjoint du ministre chargé du budget et du ministre de la justice, selon les distinctions suivantes :

1° Pour une enquête qui n’a pas été suivie d’une instruction préparatoire lorsque la désignation de l’administrateur ad hoc a été faite par le procureur de la République : Iaah1 ;

2° Pour une instruction correctionnelle lorsque les faits ont donné lieu à l’ouverture d’une information devant le juge d’instruction : Iaah2 ;

3° Pour une instruction criminelle lorsque les faits ont donné lieu à l’ouverture d’une information devant le juge d’instruction : Iaah3 ;

4° Pour une fonction d’accompagnement du mineur à une audience du tribunal correctionnel : Iaah4 ;

5° Pour une fonction d’accompagnement du mineur à une audience de la cour d’assises : Iaah5 ;

6° Pour une fonction d’accompagnement du mineur à une audience du tribunal pour enfants statuant en matière correctionnelle : Iaah6 ;

7° Pour une fonction d’accompagnement du mineur à une audience du tribunal pour enfants statuant en matière criminelle : Iaah7 ;

8° Pour la représentation du mineur lorsque l’administrateur ad hoc interjette appel devant la chambre des appels correctionnels ou la chambre spéciale des mineurs : Iaah8 ;

9° Pour la représentation du mineur lorsque l’administrateur ad hoc interjette appel devant la cour d’assises statuant en appel : Iaah9 ;

10° Pour une indemnité de carence en cas de difficultés dans le déroulement de la mission de l’administrateur ad hoc, sur la base d’un rapport indiquant les diligences accomplies, dans les conditions définies à l’article R. 53-8 : Iaah10.
