Article R2191-40 of the French Public procurement code

In the event that the substitute guarantee is not set up or completed at the latest on the date on which the contractor submits the request for payment corresponding to the first instalment, the fraction of the retention guarantee corresponding to the instalment shall be deducted by the purchaser.
When the substitute guarantee has been set up after the date fixed in the first paragraph, the amounts already deducted by way of retention guarantee shall be repaid to the contractor.

Dans l’hypothèse où la garantie de substitution ne serait pas constituée ou complétée au plus tard à la date à laquelle le titulaire remet la demande de paiement correspondant au premier acompte, la fraction de la retenue de garantie correspondant à l’acompte est prélevée par l’acheteur.
Lorsque la garantie de substitution a été constituée après la date fixée au premier alinéa, les montants déjà prélevés au titre de la retenue de garantie sont reversés au titulaire.
