Article R2196-8 of the French Public procurement code

If the contractor fails to provide the purchaser, within the time limit set by the purchaser, with information on the technical and accounting elements of the cost price of the services which are the subject of the contract, or provides inaccurate information, the purchaser may, after formal notice has remained without effect, decide to suspend the payments to be made up to a limit of one tenth of the amount of the contract when the default is due to the contractor, or withhold an equivalent amount. After a further unsuccessful formal notice, the purchaser may decide to transform this deduction into a definitive deduction, without prejudice to the possible termination of the contract to the detriment of the contractor.
When a cost estimate is made before the contract is notified, the purchaser shall indicate in the consultation documents and in the contract the penalties applicable in the event of failure to comply with the obligation set out in the first paragraph of article L. 2196-5.

Si le titulaire ne fournit pas à l’acheteur, dans le délai imparti par celui-ci, les renseignements sur les éléments techniques et comptables du coût de revient des prestations qui font l’objet du marché ou fournit des renseignements inexacts, l’acheteur peut, après mise en demeure restée sans effet, décider la suspension des paiements à intervenir dans la limite du dixième du montant du marché lorsque le manquement est le fait du titulaire ou retenir un montant équivalent. Après nouvelle mise en demeure infructueuse, l’acheteur peut décider de transformer cette retenue en retenue définitive, sans préjudice de la résiliation éventuelle du marché aux torts du titulaire.
Lorsqu’une estimation du coût de revient est effectuée avant la notification du marché, l’acheteur indique dans les documents de la consultation et dans le marché les sanctions applicables en cas de manquement à l’obligation figurant au premier alinéa de l’article L. 2196-5.
