Article R2197-10 of the French Public procurement code

The State representatives referred to in 3° of Article R. 2197-6 and in 2° of Article R. 2197-7 are chosen for each case by the Chairman from nominative lists drawn up under the following conditions:
1° The lists of State representatives are drawn up, for the National Committee, by the Minister responsible for the Economy, on the proposal of the competent Minister;
2° The lists of State representatives are drawn up, for the Local Committees, by the Prefect designated by the order referred to in Article R. 2197-3, with the agreement of the hierarchical authority to which, where applicable, they report.

Article R2197-10

Les représentants de l’Etat mentionnés au 3° de l’article R. 2197-6 et au 2° de l’article R. 2197-7 sont choisis, à l’occasion de chaque affaire, par le président, sur des listes nominatives établies dans les conditions ci-après :
1° Les listes des représentants de l’Etat sont arrêtées, pour le comité national, par le ministre chargé de l’économie, sur proposition du ministre compétent ;
2° Les listes des représentants de l’Etat sont arrêtées, pour les comités locaux, par le préfet désigné par l’arrêté mentionné à l’article R. 2197-3, avec l’accord de l’autorité hiérarchique dont, le cas échéant, ils dépendent.
