Article R221-38 of the French Monetary and Financial Code

When the holder of a popular savings passbook account ceases to meet the condition mentioned in 4° of article R. 221-33 for the second consecutive year, the holder must request that the account be closed.

Even if the account holder does not request the account to be closed in accordance with the previous paragraph, the custodian institution is required to automatically close any popular savings passbook account for which it establishes that the account holder ceases to meet the condition mentioned in 4° of article R. 221-33 for the second consecutive year or has been unable to prove that they do. Such an account is closed by 30 April of the second year at the latest and the sums in it are transferred to another account opened in the same establishment in the name of the same holder or, failing that, to a suspense account.

Lorsque le titulaire d’un compte sur livret d’épargne populaire cesse de remplir la condition mentionnée au 4° de l’article R. 221-33 pour la deuxième année consécutive, il est tenu d’en demander la clôture.

Même lorsque son titulaire n’en demande pas la clôture en application de l’alinéa précédent, l’établissement dépositaire est tenu de solder d’office tout compte sur livret d’épargne populaire pour lequel il établit que son titulaire cesse de remplir la condition mentionnée au 4° de l’article R. 221-33 pour la deuxième année consécutive ou n’a pu justifier la remplir. Un tel compte est soldé au plus tard le 30 avril de cette deuxième année et les sommes y figurant sont transférées sur un autre compte ouvert dans le même établissement au nom du même titulaire ou, à défaut, sur un compte d’attente.
