Article R23-112-4 of the French Labour Code

In the event of a tie between two or more organisations after application of Article R. 23-112-3, the seat is awarded to the employee trade union organisation that received the most votes in the professional and territorial area of competence of the committee.

In the event of a tie after application of the previous paragraph, the seat is awarded to the employee trade union organisation that received the most votes at national level in the Commission’s professional field of competence.

Article R23-112-4

En cas d’égalité entre deux ou plusieurs organisations après application de l’article R. 23-112-3, le siège est attribué à l’organisation syndicale de salariés qui a recueilli le plus de suffrages dans le champ de compétence professionnel et territorial de la commission.

En cas d’égalité après application de l’alinéa précédent, le siège est attribué à l’organisation syndicale de salariés qui a recueilli le plus de suffrages au niveau national dans le champ de compétence professionnel de la commission.
